THE CLASS ACTION RESISTING SOLDIER OF CONSCIENCE CREED

Sir, my duty is to the United States Constitution first and therefore I am now a Resisting Soldier of Conscience per Army Regulation 600-43 protected by the First Amendment of our Constitution. Therefore, I am unable to carry or use a weapon and will not participate in this alleged unconstitutional war. My subject-matter reasonable doubt defense in the first instance is to be presented to a Federal Jury as that defense arises under our Constitution and invokes Title 28 Section 1331 of the United States Codes as by Article three, section two, clause one, of the United States Constitution; Military Courts do not have subject-matter jurisdiction on my reasonable doubt defense! If any punishments are sought through the military, the United States would knowingly violate Federal Law as stipulated by Article three and the Fifth and Sixth Amendments to the United States Constitution requiring the Federal Court having my subject-matter Jurisdiction to immediately appoint me a Civilian Attorney for raising a writ of habeas corpus pursuant to Title 28 Section 2241 of the United States Codes.

 
 
 

 

FRCvP Rule 23 (a) Prerequisites; One or more members of a class becomes class action if:

(1) the class is so numerous that joinder of all members is impracticable!

Comment: There are thousands of Resisting Soldiers of Conscience!!!!

(2) there are questions of law or fact common to the class!

Comment: This website has provided Federal Questions and judicial facts common to the class of Resisting Soldiers of Conscience arising under our Constitution invoking Federal Jurisdiction and the right to present those Federal Questions and judicial facts to a Federal Jury with the 74 named concerned law professors as witnesses!!!

(3) the claims or defenses of the representative parties are typical of the claims or defenses of the class!!!

Comment: Definitely TRUE!!!!

(4) the representative parties will fairly and adequately protect the interests of the class.

Comment:  We have all been scattered by the Powers to Be and how we Unite as ONE and find representation for our CLASS is a QUESTION I would love to ANSWER!!! I am just one Soldier doing all that I can to find that ANSWER for Truth, Justice, and the American Way!

 

James Madison wrote in 1793, “In no part of the constitution is more wisdom to be found, than in the clause which confides the question of war or peace to the legislature, and not the executive department. Beside the objection to such a mixture to heterogeneous powers, the trust and the temptation would be too great for any one man..." And again wrote, "The Constitution supposes, what the History of all Government demonstrates, that the Executive is the branch of power most interested in war, and most prone to it. It has accordingly with studied care, vested the question of war in the Legislature." Hunt ed. 1906). Even Abraham Lincoln, while a Congressman, said more than half a century later “no one man should hold the power of bringing war upon us”. All Resisting Soldiers of Conscience have been isolated as one, so alone as the powers to be wish it that way, but that does not change who we are as we will always be proud Soldiers and among Soldiers it is always all for one and one for all and when one of us has lost our Bill of Rights then all Soldiers have lost them!

All three branches of the U.S. Government, failed to represent the American people about going to War with Iraq in 2003 as only one man made that decision. We the People should have made that decision! We the People through its established popular sovereignty links with the 108th Congress should have ruled, however our 535 links with the 108th Congress were stolen on March 17, 2003 while a USSC Original Jurisdictional Case trying to re-establish those links was ruled on by an inferior Article I Court contrary to Article III of our Constitution. The 2003 Iraq War has cost America billions and billions of dollars violated Articles I, II, III, & VI of our Constitution, and the 1973 War Powers Act. The 2002 H. J. Res. 114, Section 3(c)(1) violated the 1973 War Powers Act, Section 8(d)(1)&(2) implicating the 2002 Resolution was a specific authorization for the president to Declare War without Congress.

We all have been pounded within the mainstream media that everything is all right and all this protest is simply unpatriotic and does not support our troops! AMERICA!!! Our troops are no longer ours to support and until We the People re-establish our rule over our country, We the People are unable to SUPPORT OUR TROOPS and their RIGHTS! All of them, young and alone, currently have two horrible choices, ONE putting up for grabs their lives in fighting an unconstitutional War contrary to a Soldier's constitutional oath or TWO becoming a Resisting Soldier of Conscience and face a perverted unconstitutional military jurisdictional system while the rest of America watch movies, go out on dates, make a living, pay taxes, watch sports, and swallow the cleverly arranged words from our mainstream media that everything is alright! Remember THE RESISTING SOLDIER OF CONSCIENCE CREED!

This website will be offensive to some as its tough to admit to one's self that, "Hey, I have been had by my government"!  The right to be offensive is America's First Amendment right for getting the message across! In the USSC Case of Texas v. Johnson, 491 U.S. 397 (1989), the USSC mentioned the importance of protecting free speech, especially speech that is unpopular or offensive to others. It said, "If there is a bedrock principle underlying the First Amendment, it is that government may not prohibit the expression of an idea simply because society finds the idea itself offensive or disagreeable."   Honoring our Constitution is Patriotism to America!
